if you have an accident thats not your fault. but you have parking insurance. Then whos fault is it?
Question by Mino: if you have an accident thats not your fault. but you have parking insurance. Then whos fault is it?
First off i love in London Ontario Canada. A few months ago i got into an accident in which the police confirmed i was entirely innocent , and the it was the other driver’s fault. However, the police does not know that i was on “parking insurance”. (usually im on “second driver” insurance, but exactly a week before the accident i took it off, because i was traveling). I have already repaired my car on my own account without the help of my insurance company.
Now, the other driver’s company is asking me to pay for his damages. What should i do? What should I expect? Thank you.
“Parking insurance” is a type of insurance where the insurance is responsible only for damages to the vehicle WHILE its parked. So, I wasn’t supposed to be driving the vehicle in the first place. Which is why I want to know whether or not that makes me at fault.
So technically speaking…if i had normal insurance I would not be accounted for anything that happened because it was totally the other driver’s fault.
ps. thanks for the quick responses keep them up

If the police report says you were not at fault, you do not have to pay anything to the other party. Make sure you are not at fault. If you are found to be 51% at fault, you do have to pay – turn it in to your insurance.

“Fault” is not determined by the type of insurance one has or doesn’t have. Anyone can ask anybody to pay for damages and because they ask, doesn’t mean you have to pay. Since I am in the USA, I don’t understand what “parking” insurance is but since it looks like you have insurance, you should have reported all of this to your insurance company. Since it looks like you didn’t, report it now and allow them to do the job that you pay them premiums for
